I followed the development of LotRO from the very earliest dev diaries (long since gone), and the lack of PvP (in the traditional, MMORPG sense) was one of the oldest and most fundamental design decisions made. It was very clear-cut: Tolkien Enterprises forbad it. They simply didn't want anything remotely like a system that would allow elves to "gank" hobbits in The Shire (that may have been one of the earliest quotes on the subject, if I recall correctly). They insisted this wasn't consistent with their understanding of the lore, nor their vision for how the game should work.

It was only after much discussion and Intarwebs drama that Turbine was able to persuade TE to accept any form of PvP. TE reluctantly agreed to accept a system that would prevent the cardinal races (Humans, Elves, Dwarves, and Hobbits) from fighting amongst themselves. This is how we got Monster Play, instead of the "true" PvP that you see in DAoC, GW, WoW, and other MMORPGs.

One of the compromises suggested was to do what WoW has done: allow players to create "evil" characters on the "other" team, ala Alliance versus Horde. Unfortunately, Turbine and TE were either unwilling or unable to come up with a way to do that with the limited development time and resources.* Both Turbine and TE wanted to concentrate on delivering a rock-solid PvE game with the cardinal races as their priority. Creating a Sauron side would essentially double much of their workload, as they'd have to create art and content for the new races. And that would have added PvP balance as a sizable set of tasks to test and QA. They simply didn't want to add that much drag to the project.

But they completely never closed the door on that idea, either. It's conceivable that, at some point in the future, they'll create the additional art and content for races and classes on team Sauron. And it would only be logical for those player characters to confront and combat the forces of "good" in Middle Earth. If you stop and think about it, Monster Play is kind of like that already, albeit it in an embryonic form. Although it's far from perfect or complete, it's a good start, and may eventually become the seed from which a full-blown Good vs. Evil PvP system is grown.

(edit) *: Additionally, I recall a discussion about how little lore exists on the subject of the evil races. Tolkien didn't really flesh out much information about the dark side. He simply never provided enough information from which robust game content could be produced. Where did the evil races come from? What are their motivations (aside from the obvious)? What do they want, as individuals? What do they value/cherish? Why are they "evil"? What do they eat, when/if do they sleep, how do they reproduce, etc.? These questions need to be answered in order to create content: towns, quest objectives, loot, clothing, foodstuffs, etc.

At the time, TE didn't have the data (technically, still doesn't), and Turbine certainly wasn't going to make it up along the way (although some may argue with me on that point, given the liberties they've already taken in LotRO). At least, they weren't going to do that before creating a good game based on the information they DID have at the time. Maybe now, after Turbine's relationship with TE has matured, would TE be willing to grant Turbine the additional liberties they'd HAVE TO take in order to develop content for Sauron's side.
